Macao Smart Performs Data Protection Challenges

According to a recently published paper by Macao-based lawyer Pedro Cortés, "exploring data protection regulations" presents "multifaceted challenges for casino game concessionors seeking to integrate in operating so-called "smart" tables, including Radio Frequency Identification (RFID) technology."

The effort not only underscores "the foremost importance of protecting customer data," but also "creating an environment of trust and transparency within the constantly evolving casino gaming sphere," Mr. Cortés wrote.

His paper 'Voyage in Regulated Waters: Implications of RFID Game Chips in Macau Casinos' was published on Tuesday in Lexology, a UK-based legal business research website.

In his article, Mr. Cortés of Macau law firm Rato, Ling, Lei & Cortés noted that Macau's casino regulator, the Game Inspection and Coordination Bureau, was encouraging operators to "achieve more comprehensive management with technology, such as increasing smart gaming tables, and at the same time work with the government's e-administrative functions."

Mr Cortes wrote, "In accordance with the Privacy Act of Macau (Act 8/2005), privacy managers must embrace the fundamental principle that processing should be carried out through transparent and strict respect for the privacy of life, as well as the fundamental rights, freedoms and guarantees provided for in the Basic Act of the Special Administrative Region of Macau."

He also noted that privacy laws "emphasize the importance of controllers collecting, storing, and processing only the customer data they need to minimize privacy risks and enhance data security."

"Encryption plays an important role in protecting customer data, and requires robust protocols to maintain data integrity, prevent unauthorized access, and enhance overall security measures," the attorney added

Mr. Cortés noted that Macau casino game concessions "will also have to adhere to general data protection rules, which include covering transparent data processing practices, securing customer consent, and maintaining data subject rights to protect customers' privacy and data accuracy."

Ignoring these practices "could cause significant harm and consequences to the industry as trust and trust within the gaming ecosystem are key to success," he added.

"Regulators are likely to strengthen their supervisory framework, audit procedures and compliance monitoring mechanisms tailored to this technology," the lawyer said, due to the widespread use of RFID game chips in Macau.
